WeLink Terms and Conditions of Service
Welcome to welink.co.nz (our "Service"). This page, together with any documents referenced herein, outlines the terms and conditions under which our platform connects businesses and workers (the "Services") for job opportunities. By using our Service and engaging with job listings, you agree to be bound by these terms and our terms of use policy. Please read these terms carefully before registering or accepting jobs through our platform. If you have any questions or need clarification regarding these terms, please contact our support team at [support email] before proceeding. If you do not agree with these terms in full, please do not use our Service.
1. INFORMATION ABOUT US
welink.co.nz is a platform operated by WELINK LIMITED ("we," "us," or "WELINK LIMITED"), incorporated and registered in New Zealand, with a physical office located in Wellington, New Zealand. Our company registration number is 9374738. WeLink connects businesses with skilled workers for flexible job opportunities. Jobs are provided by independent businesses (our "Partner Companies") and completed by independent workers (our "Partner Workers"). Our platform is designed to make hiring and work seamless, reliable, and efficient for everyone involved.
2. PURPOSE
The purpose of our Service is to provide Customers with access to packaged service offerings that make getting work done easy, fast, and reliable. Through our technology, Clients can purchase pre-defined service packages that connect them with Partner Companies and Workers who deliver the selected services. Each package represents a service engagement, not an hourly hire arrangement, ensuring clarity and transparency for both Clients and payment partners.
3. SERVICE AVAILABILITY
Our platform provides a simple and efficient way for companies to connect with available workers across various industries. Each worker has their own availability, and our system ensures that you can see who is ready to accept jobs in real time. Jobs can only be offered to workers within relevant locations or skill sets, as determined by your posting and the worker’s profile. Operating hours and response times may vary depending on worker availability. Through our app, you can quickly post tasks, view responses, and confirm workers—all facilitated through our technology to make hiring fast, easy, and reliable.
4. JOB BOOKINGS
When you confirm a booking through our Service, you are purchasing a defined service package from a Partner Company, facilitated via the WeLink platform. The contract for that package is formed directly between you (the Client) and the Worker once payment has been processed and the Worker accepts the job. Each service package is clearly described within the app or website prior to checkout, including its inclusions, duration, and total cost.
5. CANCELLATIONS
Cancellations of a booked job must be made at least 4 hours before the scheduled start time. If a cancellation is made within this period, you may choose to receive a full refund or have the amount credited to your account for future use. If a cancellation is made less than 4 hours before the job is due to commence, a 30% service fee of the total booking amount will apply. The remaining amount will be refunded or credited to your account, at your choice. This policy is in place to ensure responsible booking and respect to all parties involved. It helps prevent last-minute cancellations, protects workers’ time, and ensures our service remains reliable for everyone using the platform.
6. PRICING AND FEES
All listed prices represent the total cost of a service package prior to GST and any applicable payment processing fees. GST is displayed at checkout for transparency. If you choose to pay using a Buy Now, Pay Later (BNPL) provider such as Afterpay or another approved third-party service, any applicable processing fees or instalment terms will be shown clearly before confirmation. WeLink does not determine or collect BNPL interest or late fees — these remain solely between the Customer and the BNPL provider.
7. JOB CONFIRMATION AND ARRIVAL POLICY
Once a booking has been completed through our platform, you will receive a confirmation message containing the full details of your job request. This confirmation serves as your receipt and acknowledgment that payment has been successfully received. After payment is confirmed, the assigned worker’s GPS will automatically activate and guide them to the address you have provided. During this time, in-app messaging will remain open, allowing clear communication between you and the worker to ensure smooth coordination before and during the job if need be. Workers are expected to arrive on time and prepared for the task. Should any issues arise with arrival, directions, or communication, our support team is available to assist at admin@welink.co.nz. We are committed to providing a reliable, transparent, and professional service experience—ensuring that every job runs smoothly from confirmation to completion.
8. REFUND POLICY
In the event of a refund, the amount will be processed back to your original payment method. For Customers who paid via a BNPL provider, refunds will be applied in accordance with that provider’s terms — WeLink will issue the refund through the same payment channel, and the provider will adjust your instalment schedule accordingly. Refunds apply only to service packages purchased through WeLink and are handled case-by-case to ensure fairness to all parties. Contact admin@welink.co.nz for any queries in to this.
9. OUR LIABILITY
To the extent permitted by law, WeLink provides our Service and its content on an “as-is” and “as available” basis. We make no representation or warranty of any kind, express or implied, regarding the availability, reliability, or suitability of our Service, nor do we guarantee that it will be uninterrupted, timely, secure, or error-free. While we take every measure to ensure a high standard of professionalism across our platform, WeLink does not accept responsibility for the performance, actions, or conduct of independent workers or companies using our Service. Each party operates independently, and any agreement to perform work is made directly between them. Neither WeLink, nor any Partner Worker, nor any Partner Company shall be liable to you for any direct, indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of—or inability to use—our Service. In the event that WeLink is found to be liable to you for any reason, our total aggregate liability will not exceed the total amount paid for the specific job in question. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other matter for which it would be unlawful to limit or exclude liability.
10. WORKER STATUS AND INDEPENDENT CONTRACTOR RELATIONSHIP
All Workers engaged through the WeLink platform operate as independent contractors, not employees, agents, or representatives of WeLink Limited. WeLink does not control or direct how work is performed and does not provide employment benefits, insurance, or holiday pay. Workers are solely responsible for ensuring they hold all necessary qualifications, certifications, and licences required for the work they undertake, and for meeting all legal obligations under New Zealand employment, health and safety, and taxation laws. Clients acknowledge that hiring Workers through WeLink does not create an employment relationship between the Client and WeLink. Each job agreement exists directly between the Client and the Worker.
11. HEALTH AND SAFETY COMPLIANCE
All Users must comply with the Health and Safety at Work Act 2015 (NZ) and any other applicable workplace regulations. Clients are responsible for providing a safe work environment and any site-specific hazard information. Workers must follow all reasonable safety instructions, use required protective gear, and immediately report any hazards or incidents. WeLink may suspend or remove any User who fails to comply with these safety obligations. While WeLink facilitates job connections, it is not responsible for on-site safety, supervision, or enforcement of safety practices.
12. INDUSTRY-SPECIFIC GUIDELINES
Certain industries, such as construction, hospitality, logistics, and cleaning, may have additional legal or licensing requirements. WeLink may issue separate Industry Appendices outlining these requirements. By accepting jobs in a specific category, the Worker agrees to comply with all applicable appendices and industry obligations. As new industries are added, additional appendices may be published on our website or app and will automatically form part of these Terms.
13. INSURANCE AND TAX RESPONSIBILITIES
Workers are responsible for maintaining any required insurance policies, including but not limited to personal liability or public liability cover, vehicle insurance (if applicable), and ACC compliance. Workers are also solely responsible for their own income tax, GST registration (if applicable), and compliance with Inland Revenue requirements. WeLink Limited does not deduct PAYE, ACC levies, or any other withholdings on behalf of Workers.
14. CONDUCT, RATINGS, AND SUSPENSIONS
WeLink promotes professionalism and reliability across all Users. Workers and Clients must treat each other respectfully and comply with all applicable laws. Users may be rated after each completed job to ensure ongoing quality and transparency. WeLink reserves the right to suspend or permanently remove any User whose conduct is deemed unsafe, unlawful, or inconsistent with platform standards.
15. DISPUTE RESOLUTION
Any dispute between a Worker and a Client should first be addressed directly through in-app communication or by contacting WeLink support at admin@welink.co.nz. If the issue cannot be resolved informally, WeLink may, at its discretion, offer mediation through an independent third party. Nothing in this clause prevents either party from pursuing legal remedies through the New Zealand courts if mediation is unsuccessful.
16. LAW AND JURISDICTION
These Terms, and any dispute or claim arising from or relating to the use of our Service, shall be governed by and interpreted in accordance with the laws of New Zealand. By using our platform, you agree that any legal action or proceeding arising under or in connection with these Terms shall fall under the exclusive jurisdiction of the New Zealand courts. This ensures that all matters are handled fairly, transparently, and in accordance with New Zealand legal standards, protecting both users and our platform under a single, clear framework.
17. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
We reserve the right to update, amend, or revise these Terms and Conditions at any time. Any changes will be posted on this page, and you are responsible for reviewing them periodically. Continued use of our Platform or Services after any changes constitutes your acceptance of the updated Terms. APPENDICES AND INDUSTRY POLICIES From time to time, WeLink Limited may release additional appendices that set out specific rules or guidelines for certain job categories. These documents form part of the overall Terms and are binding on all Users undertaking work in those categories. Example appendices may include: ● Appendix A – Construction & Trades ● Appendix B – Hospitality & Events ● Appendix C – Transport & Delivery ● Appendix D – Cleaning & Maintenance
18. OFF-PLATFORM CONTACT AND DIRECT ENGAGEMENT
To protect the integrity of our platform and ensure fairness to all users, any attempt by a Client or Worker to arrange, negotiate, or complete work outside of the WeLink platform is strictly prohibited. This includes, but is not limited to: ● Exchanging personal contact details to organise future jobs privately, ● Making or accepting payment directly without using the WeLink system, or ● Contacting another User for work that was first introduced through the platform. If WeLink becomes aware of any such conduct, it may result in immediate account suspension or permanent removal from the platform for both parties involved. WeLink reserves the right to recover any fees or commissions lost as a result of off-platform arrangements.
19. WORKER RELEASE FEE (FULL-TIME HIRE)
If a Client decides to hire a Worker introduced through the WeLink platform on a permanent, full-time, or long-term basis (outside the platform), the Client agrees to pay WeLink a Worker Release Fee equal to one (1) week of the Worker’s average pay based on their most recent WeLink engagements. This fee recognises the introduction and connection made through the platform. The Worker Release Fee must be paid to WeLink within seven (7) days of the Worker’s first day of direct employment or engagement with the Client. Failure to notify WeLink of such an arrangement or to pay the fee may result in: ● Suspension or removal of the Client’s account; and ● WeLink reserving the right to pursue recovery of the unpaid fee through lawful means. This clause ensures WeLink remains a fair and sustainable platform that continues to connect skilled workers with opportunities..

While we verify profiles and maintain a secure system, we do not guarantee the quality, safety, or legality of work performed by users.
All users are responsible for their own compliance with workplace laws, safety regulations, and contractual obligations.
WeLink will not be held liable for any loss, damage, or dispute arising from the use of the platform.
